Man goes to prison for shooting brother-in-law

JACKSONVILLE, Fla. -

A man who sought protection under Florida's so-call "stand your ground" law has been sentenced to nearly six years in prison for killing his brother-in-law.

Circuit Judge Brad Stetson ruled Thursday that 60-year-old Clifford Eugene Van Dyke will get credit for the 925 he's already spent in jail.Marvin Gilhousen Jr.

Van Dyke's attorneys tried to free him last year by arguing that he feared for his life at the time of the July 2010 shooting.

Police and neighbors testified that 61-year-old Marvin Paul Gilhousen Jr. (pictured, right) had beaten Van Dyke up and threatened him. Van Dyke shot Gilhousen in the chest and head.

The judge declined to set Van Dyke free on the stand your ground claim, but said it was a close call.
