Smoking bans for Sarasota

Sarasota County commissioners are calling for new legislation to allow smoking bans in public places.

Right now counties don't have the authority to ban smoking at public beaches, outdoor sports facilities or parks.

On Tuesday, the court attorney told commissioners that local governments do not have the authority to ban smoking in public outdoor areas. Only the Florida Legislature can ban smoking.

Commissioners asked the Legislature for a new bill that would give counties the authority to ban smoking in public outdoor places.

In December 2012, Sarasota County Judge Maryann Boehm ruled that Sarasota's ordinance banning smoking in public parks was unenforceable and that regulating smoking should be left to the Legislature.
