A South Florida judge has allowed a baby tossed in a lake by his mother to remain in his father's custody, over objections from the state.
Broward Circuit Judge Susan Lebow on Thursday found no probable cause to remove Cayden Armour from his father's care. The Miami Herald reports (http://hrld.us/1t5PcRU ) that the 3 month old remains hospitalized in critical condition.
Cayden's mother, Inakesha Armour (pictured above), told police she was suffering from postpartum depression when she threw the infant in a lake Tuesday.
A Department of Children and Families spokeswoman said the state believed Conlan Armour had not done enough to protect Cayden from his mother, who had previously tried to harm him.
Lebow said Armour had not left Cayden alone with his mother and did not pose a threat to the baby.
According to WPLG Local 10, a nurse helped rescue Cayden, performing CPR on him and calling 911 after she saw him lying on the grass.
