BARTOW, Fla. -

A central Florida woman will serve 10 years of probation for failing to supervise her 1-year-old son, who drowned.

Last week, Circuit Judge Glenn Shelby went against a prosecutor's request to sentence Deborah Vance-Shipp to 111 months in prison.

The Ledger of Lakeland reports that Shelby also agreed to withholding adjudication, which keeps Vance-Shipp from having a felony on her record.

James Shipp drowned in February 2012. Vance-Shipp told investigators she was bathing her older son and left the drain open so the water would flow while she went to the kitchen. She said when she returned the water was filling up in the tub and the baby was unresponsive.

Police recovered drugs at the house during the investigation. She no longer has parental rights to her older son.
