Tallahassee attorney Timothy Jansen said Winston has not been questioned by police.

"We thought the matter was closed back in February," said Jansen. "We don't know why it's been reopened."

Jansen also said they are cooperating with the investigation and they hope its gets resolved soon.

Florida State sent Channel 4 a statement that said they are aware of "a matter that was investigated by Tallahassee police almost a year ago. Because the investigation has not been closed by TPD, we cannot comment further at this time."
