Teen accused of sex with minor at mental health facility

JACKSONVILLE, Fla. – A 17-year-old boy was arrested last month on a charge lewd and lascivious battery and engaging in sexual activity with a person 12 or older but younger than 16 at the Mental Health Center of Jacksonville.

On Sept. 29, a staffer found the 17-year-old and the victim in the same room engaged in sex, according to a police report.

The victim first told the staffer it was consensual, then said he had been sexually assaulted, according to the report.

When the victim met with a police detective at the hospital, he said it was consensual. The 17-year-old also told police it was consensual.

The Department of Children and Families is investigating.
