Woman, 21, arrested in justifiable killing of home invader

Police: Couple shot, killed man who broke into home last week

JACKSONVILLE, Fla. – A 21-year-old woman has been arrested in connection with the justifiable shooting death of a home invader last week in Arlington.

Jessica Fain (pictured) was a friend of 21-year-old Marquise Yates, who was shot and killed by a middle-aged couple he assaulted. She's being charged with an open count of murder. The State Attorney's Office said it still hasn't decided on what formal charges will be filed.

Investigators said Yates broke into the home on Seabrook Cove Road before dawn and threatened the homeowner at gunpoint.

In court Thursday morning, prosecutors said Fain drove Yates to the house and waited. They said she lives on the same street where the home invasion took place.

Yates had been released from prison in April.

News4Jax learned that Fain lived just a few homes away from where she waited for Yates.  Channel 4's Heather Leigh spoke to neighbors in the area Thursday night, who said they are still fearful over what happened in their neighborhood last week.

Neighbors said they had seen Fain outside the home before, but didn't know much more than that.

"Very sporadic. Nothing consistent and I couldn't tell you if that was her directly, other than it looked like her," said neighbor, Alan Hozeny.

News4Jax asked Crime and Safety Analyst, Gil Smith Thursday night about Fain's arrest and how the neighborhood will recover from the crime.

"No neighborhood is 100% safe even a gated community has criminal activity. That's when people need to be the most alert because usually when it's a nice quiet neighborhood, you usually let your guard down, and we saw what happened here," said Smith.
